Cannot see NBA Live 08 in DirectX 10

I just have to get an ATI Radeon 4870, and installing Vista I can't see NBA Live 08 in DirectX 10, it still running in DirectX 9.0c. Maybe I miss to do something?

Here's my specs:

AMD Athlon 64 3700+@2.64 Ghz
2Gb RAM OCZ 2-3-2-5 1T
Asus A8N-SLI Premium
ATI Radeon 4870 512Mb
Windows Vista Ultimate SP1

So why I'm having this issue?. I tried to reinstall the game, but the problem persists. Maybe this is due of my single core processor?

It shouldn't be, your specs are definitely enough to run NBA Live 08.
