In the absence of agreement, we ask that you do not use it.

It's a shame they've taken their stance. It's possible they might let it slide if you explain that it's not for profit and that you'll stress it's an unofficial mod for a video game, not a commercial product, but if they're going to insist on making it a copyright issue then that's very unfortunate.
