Go to this location:

My Documents -> NBA Live 08 -> saves

Find a folder which is named the same as your save name in game and enter it.

Open the file players.dbf with DB Commander.

When it's opened, find the line with Jerome James.

Then find the fields "TEAM" and "CASH_TEAM" and change values of both to 50.

Save and quit. You're done. James should be now in free agents pool and his cash shouldn't count to your team salary.

If you're playing on the console or want to try and do it without editing though, you'll probably have to package him with someone else and try for an expiring contract or throw him into a deal that needs a bigger contract to work under the cap. You'll want to make sure the offer is pretty appealing for the CPU to want to take on his contract though.
