High FPS (tearing) but low with vsync on?

Hi, am a bit stuck on an issue. Just got NBA 2k14 for PC and am having issues with the frame rate. Running an i5 4670 and an ATI 280X so more than enough power for the game. Is only 6 months old and a fresh Windows 8 install.

On max settings at FHD (normal 60Hz monitor), with vsync off, I'm getting around 120 FPS which is obviously smooth but I don't like the tearing I'm seeing so I thought I'd just play with vsync on since I'd be more than happy with 60 FPS but no screen tearing. When I put vsync on though, I can only get 45-46 FPS on max settings. I was expecting this to be locked at 60 FPS.

Even at 45-46 it's more than playable and there is no tearing but with a more than capable GPU, does anyone know why I'm not getting my FPS locked at 60? Starting to get a little bit annoying and I can't figure out a way to fix it. I've tried deleting the config file to let the game re-create it, tried lowering the settings (not that I should have to) and still it's around that 44-45 FPS. Have even tried RadeonPro with it's frame limiter and adaptive vsync but that didn't work either.

Any ideas? I'm completely stuck how I can get high FPS with vsync off and under 60 with it on.

EDIT: Something just came to be but in the graphic settings, the game is locked to a refresh rate of 23. Double that is the FPS it's locked at with vsync on. Even if I put 59 or 60 in my config file, it goes back to 23 for some reason. Is possible that's the issue too?
