As already said, it's your videocard. I'm using Windows 7 x64 and I don't have problems like that (dual GeForce 8600GT 256MB). You could upgrade it to 9600GT and it would be a huge difference.

Its your processor. You need a QuadCore for the maximum 60 FPS otherwise the maximum for your dual core is 35 FPS

I've read people getting 90 FPS with Quad core.

I have my NBA 2k10 on Windows 7. Everything runs on high settings with some tweaks on nvidia control panel. My fps runs from 55-60 during gameplay. When I set stall_cpu_on_end_frame to 0, I got 59-60 fps.

I'm running Windows 7 with HD 3850 256mb and my settings are

1920x1080
everything on high and on except for MSAA at 4x and stadium detail at medium. Getting much better performance than on Vista which I played 2k9 on.

So 4770 should have no problems :)

Can I upgrade from windows 7 home premium to windows 7 professional? I am going to get a free windows 7 home premium upgrade in the mail, and I then want to buy a windows 7 professional upgrade for $30 since I am a college student. Will that require a clean install?

Yup, I was a little worried, but it seems slightly smoother than on Vista.

I may be able to shed some light on the situation...
I think maybe you should look at your RAM. I'm only running an nVidia 8800 graphics card but I have 4GB RAM.
By all means upgrade your graphics card too because you'll obviously need it in the future, but just as necessary is a RAM upgrade. Double it to 4GB and you should find hopefully that the game runs fine with the graphics card you have now. Windows 7 64-bit can utilise the full 4GB, so make the upgrade and enjoy your smooth new system.

The "high" mode implies much more info that your graphic card has to process compared to the "medium" mode, so that's ultimately what's making the difference here. With a GPU that could better handle physics, like the GTX series, you probably would have too much of a hit.
Your CPU may be a little short too, but I don't think it's the bottleneck here.

@guillaume - thanks man. but i think its my processor thats the problem. i have a friend that has the same graphics card as mine and his processor is phenomx4 2.3ghz. my other friend has geforce 9400gt but has phenomx4 9550 (2.2ghz). both of them have fps of 50 when playing HIGH player settings.

When i have WinXP SP3, on my Core2Duo E4500 2.8Gz, Geforce 9600 GT 512mb, 2 gb ram i have all on high settings in res. 1680x1050 45-50 fps! But now i installed Win7 32-bit and have only 20-25 fps  Only in player setting on medium i have 40-45. So i think, the problem is that nba 2k10 have problems with optimizaiton on win7 (except high-end PCs of course). I hope i wrong and there exists a solution to solve this problem....

P.S. For experiment, i installed on my Win7 NBA 2k9, and have the same problem – in player on ultra high setting (cloth physics) i have performance fall too, on XP far as I remember, i have 60 fps with all on maximum...
