So did they say the signature shots would actually be in the current gen games? If they did, I don't think you'd get much sueing over that 
And calling it a basketball game... the game is still a basketball game and for the average fan, it's a basketball game cause it has a ball, 5 players on the court at a time, incorporates all the rules, etc... I don't think that would be a very good arguement to use in court...
